The Expatriate Services Division of the Immigration Department provides types of visas related to expatriates:

  1. Employment Pass (Category I) – expatriate
  2. Employment Pass (Category II) – expatriate
  3. Employment Pass (Category III) – knowledge / skilled worker
  4. Professional Visit Pass
  5. Dependant Pass
  6. Social Visit Pass (Long Term)
  7. Social Visit Pass – Internship (SVP-I)

Emploment Pass (EP)

Dependent Pass

  • Eligibility Criteria:
  • Legal spouse of an Employment Pass holder; OR
  • Children under 18 years old (biological, stepchildren, or legally adopted) of an Employment Pass holder
  • Disabled children of any age

Features:

  • Grants the holder the right to reside in West Malaysia
  • Employment is not permitted; a conversion to an Employment Pass is required for work eligibility
  • For social and welfare activities, holders may request special permission from the Malaysian Immigration Department
  • Processing time: Approximately 14 working days

Social Visit Pass (Long Term)

Eligibility Criteria:

  • Children aged 18 to 25 years old (biological, stepchild, or legally adopted, excluding those with disabilities) who are unmarried, not employed, or studying in Malaysia; OR
  • Children of a common-law spouse from a previous relationship under the age of 7; OR
  • Parents and Parents-in-law of an Employment Pass holder; OR
  • Common-law spouse of an Employment Pass holder (can be considered)

Features:

  • Allows the holder to reside in West Malaysia
  • Employment is prohibited unless converted to an Employment Pass
  • Study is not permitted unless converted to a Student Pass
  • Only one application is allowed, and changes to the common-law spouse partner are not permitted
  • Processing time: 14 working days
  • Maximum approval duration is 12 months, subject to the principal pass holder’s visa validity or passport validity, whichever expires first.

Employers shall provide the following requirements to apply for expatriates:

  1.  Minimum capital requirement  100% of local (Malaysian) RM 250,000.00
  2.  Joint ownership of foreign and local RM350,000.00
  3. 100% foreign ownership RM500,000.00
  4. Distribution of merchantability and RM1,000,000.00 restaurant possession of foreign
  • Foreign-owned companies (foreign equity at 51% and above) operating in the Wholesale, Retail and Trade (WRT) sectors (mandatory requirement to submit valid WRT approval letter, if applicable). Please refer to the Ministry of Domestic Trade, Co-operatives and Consumerism for WRT license application guidelines)  
  • Foreign-owned companies (foreign equity at 51% and above) involved in the sub-sectors of unregulated services are
    required to refer to the Services Industry Division, Ministry of Domestic Trade, Co-operatives and Consumerism on the application guideline to obtain approval.
